Legal Guarantee
Statutory legal guarantee rights apply to all goods purchased from Cultulu. On this page you can find information about what the legal guarantee means, when a lack of conformity may exist, and which types of damage are not covered by the legal guarantee.
What does the legal guarantee mean?
The legal guarantee applies to defects or lack of conformity. In simple terms, the goods must comply with the agreed and legally required characteristics at the time they are delivered.
A lack of conformity may exist, for example, if an item already had a material, manufacturing or workmanship defect at the time of delivery.
However, the legal guarantee is not a guarantee that a product will remain free from wear or damage for two years regardless of use, care or mechanical stress.
How long do legal guarantee rights apply?
For new goods, the statutory limitation period for claims relating to defects is generally two years from delivery.
This does not mean that every type of damage occurring within these two years automatically constitutes a lack of conformity. The cause of the damage is an important factor.
What is not covered by the legal guarantee?
Damage that occurs only after delivery as a result of use, wear or improper handling generally does not constitute a lack of conformity where the damage was caused by such circumstances.
This may include in particular:
- normal wear and ordinary signs of use,
- damage caused by improper or unintended use,
- excessive mechanical stress or overstretching of the material,
- damage caused by wearing an unsuitable or excessively small size,
- damage resulting from failure to follow the care instructions,
- machine washing where hand washing is specified for the item,
- the use of unsuitable detergents, cleaning agents or care products,
- damage caused by heat, rough surfaces, sharp objects or comparable external influences,
- material-related changes caused by normal use where these are not the result of an original material or manufacturing defect.
Special care for delicate materials
Many products offered by Cultulu are made from particularly elastic, glossy, coated or otherwise delicate materials. These include, for example, wetlook, polyurethane, coated stretch and mesh materials.
Please always follow the care instructions for the respective product or those provided by the manufacturer. Where hand washing is specified, the item should not be machine washed or spun.
Excessive stretching, friction against rough surfaces and excessive mechanical stress can also permanently damage delicate materials. Damage demonstrably caused by such treatment is not the result of an original lack of conformity.
What happens if a product is defective?
If a statutory lack of conformity exists, you are entitled to the legal remedies provided by law. These generally include, in the first instance, bringing the goods into conformity, for example by repair or, where the legal requirements are met, replacement with conforming goods.
Under the applicable legal conditions, additional remedies such as a price reduction or termination of the contract may also be available.
